This is a two-day seminar intended for senior land personnel who are involved with joint interest agreements on a day-to-day basis and therefore require a thorough understanding of the CAPL Operating Procedure.
The CAPL Operating Procedure is the industry benchmark document for operations conducted on jointly held lands. It sets forth procedures for dealing with AFE’s, Operators’ rights and duties, indemnification and liability, insurance, marketing, independent operations, facilities construction, rights of first refusal and many more items of concern that arise between joint interest parties. In this seminar, the CAPL Operating Procedure will be discussed in detail with particular emphasis on its day-to-day application, focusing on the most current version of the CAPL Operating Procedure. Comparisons will be made to previous CAPL Operating Procedures in certain key areas.
Mr. O’Byrne is President of O’Byrne Resource Management Ltd. and Manager of Oil and Gas Operations for Berkley Resources Inc. Prior to establishing his resource management company in April 1991, Jim O’Byrne worked as Land Manager for major, funded and independent oil and gas companies. He drafted the first CAPL Operating Procedure in 1969 followed by CAPL1971, CAPL 1974 and CAPL 1981, and chaired the Committee that published the CAPL 1990 Operating Procedure. He is currently a member of the 1990 CAPL Operating Procedure Update committee.
Jim MacLean is President of MacLean Resource Management Ltd., a land consulting company that specializes in training and mentoring, problem resolution and assisting clients with complex agreements. Previous to this, he was with Chevron Canada Resources in Land for close to 25 years after his graduation from law school in 1980. At Chevron, he worked on assignments in Frontier, conventional Western Canadian negotiations, Acquisitions and Divestitures, Planning and had been Manager, Land between 1994 and his departure from Chevron in the spring of 2005.
He has worked directly on a number of industry standardization and work process improvement initiatives, and has been the principal draftsman of a number of industry documents. These include: (i) the 1990 CAPL Operating Procedure; (ii) the 1997 CAPL Farmout & Royalty Procedure; (iii) the 2000 CAPL Property Transfer Procedure; and (iv) the pending update to the 1990 CAPL Operating Procedure. He has also been an instructor at CAPL courses on the Operating Procedure, the Farmout & Royalty Procedure and A&D/the Property Transfer Procedure for a number of years.
